All orders accepted by"XPOWER EXHAUST SYSTEMS" MTECH PERFORMANCE MARKETING, Company No. PG0170919-K, which is under company of MTECH RACING SDN BHD are subject to these terms and conditions of sale, which supersede any previous terms and conditions.
PRODUCT DESCRIPTIONS AND PRICING
Information provided on this website is understood to be as accurate as possible, however we do not claim that product descriptions or other content of this site is accurate, complete, reliable, current, or free of errors. If a product offered by "XPOWER EXHAUST SYSTEMS" is not as described, you are advised to make a claim in writing within seven days of delivery.
PRICES / ORDERING
To assist in prompt despatch please ensure you order against the correct products and descriptions as supplied on this website. Orders can be placed by telephone, by post or via the order form on this website. All exhausts are manufactured to order and can take up to 7 working days to be despatched.
Purchasers are advised to check that goods ordered are compatible with cars which have been modified, adapted or altered. If goods ordered by the purchaser are not compatible due to modification, adaptation or alteration, "XPOWER EXHAUST SYSTEMS" accepts no responsibility for the error and a refund will not be given.
PAYMENT
Payment must be made by online transfer , credit or debit card with order by phone, post or website. We accept Visa, MasterCard, Online Transfer on our secure server, which is completely safe. We also accept Paypal payments. We cannot accept American Express cards. We reserve the right to refuse any credit or debit card transactions. "XPOWER EXHAUST SYSTEMS" can only ship goods to the credit or debit card holders address.
DELIVERY
Please allow up to 7 working days for delivery within the malaysia. For goods that are shipped overseas, please allow up to 10 working days for delivery. Malaysia orders will be despatched by Pos laju , skynet or lineclear next day courier service, excluding Saturday, Sunday and Public Holidays. International orders will be despatched by FEDEX , GDEX courier service, excluding Saturday, Sunday and Public Holidays. All goods require a signature upon delivery. Goods will not be left at any address without a signature. Any claims for non-delivery, damage or shortages must be made in writing within seven days of delivery. NO CLAIMS WILL BE ENTERTAINED AFTER THIS PERIOD.
CANCELLATION
All exhausts are built to order and any purchaser cancelling an order must do so in writing within seven days of placing the order. If at any point a purchaser cancels the order, they will be charged a 20% cancellation fee. Cancellation of goods is not prohibited once the exhaust has been fitted.
REFUNDS & RETURNS
Returns are only accepted if the goods have been damaged in transit or have been supplied incorrectly. Goods must be packaged in the same manner that they were delivered to avoid damage in return transit. "XPOWER EXHAUST SYSTEMS" will not stand the cost of any return carriage charges where damage has occurred. Any goods returned incomplete i.e. packaging missing, accessories missing etc will not be replaced or credited. Similarly any goods found to have been used will not be replaced or credited.
GUARANTEE / WARRANTY
"XPOWER EXHAUST SYSTEMS" are supplied with a 1 YEAR guarantee for goods manufactured. The warranty is for goods that are "XPOWER EXHAUST SYSTEMS" fitted to parts and are not guaranteed for fitment onto other brand aftermarket parts. The warranty is valid for the original purchaser only and is non-transferable. Purchasers are advised to retain the original invoice as this acts as proof of purchase. The guarantee does not include the exhaust wadding as repacking is recommended every 1-2 years depending on your bike model. See our FAQs page for full details.
The exhaust must have been repacked by us to maintain the warranty. Goods that have been altered by others will not be covered under warranty. Goods must have been fitted using the fittings and as per the instructions supplied. In the event of products being discontinued, a similar product may be supplied if available.
In the event of a warranty claim being made, the purchaser must contact "XPOWER EXHAUST SYSTEMS" via email (Xpower88@hotmail.com) quoting their full name and invoice number along with details of the issue. It is recommended images that detail the issue are included in the email when raising a warranty claim. Any goods returned under warranty are done so at the purchasers cost. "XPOWER EXHAUST SYSTEMS" will cover the costs of return carriage to the original purchaser, once any warranty work has been completed.
RESERVATION OF TITLE
The risk of the goods passes to the purchaser upon delivery from the carrier. Purchasers are advised to check goods before signing as claims for damage cannot be made if the goods have been signed for as received in good condition. The Title in the goods remains vested in us and shall only pass from us to the purchaser once full payment has been made by the purchaser.
ELECTRONIC COMMUNICATIONS
When you visit "XPOWER EXHAUST SYSTEMS" website or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically by email. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
